IPO IPR review backlog reduced to zero

In May, the Intellectual Property Office (Initial Public Offering) cleared its exam backlog for the first time in several years. Backlogs refer to cases that take longer than Initial Public Offeringservice standards. It follows two of the busiest years of Initial Public Offeringwhere a record number of applications and change requests were received.

The elimination of backlogs has resulted in faster service for Initial Public Offeringcustomers. Over the past three years, customer satisfaction Initial Public OfferingThe speed of the patent examination service nearly doubled from 42% in 2019 to 75% in 2022.

Globally, Initial Public Offering achieved a customer satisfaction score of 88% in March 2022, a score which is among the highest in the UK across all industries. It also exceeded its departmental target of 85%.

The patent examination backlog

The patent examination backlog has grown steadily over the past two decades. Late patents are those that have not been reviewed more than 42 months after the initial application.

Over the past three years, the number of overdue patent examinations has fallen from 13,000 to zero. The scale of the work is unprecedented for Initial Public Offering. Last April, the patent backlog stood at 6,007 cases, consisting of 12,000,000 pages.

The backlog of trademarks and designs

In 2020 and 2021, there was also a significant backlog of trademark and design applications, caused by three main factors:

1. The number of trademark applications has exploded. National trademark applications have more than doubled in five years, from around 65,000 to more than 150,000 last year.

2. Since the UK has left the European Union, customers must now apply to UKIPO if they wish to benefit from UK protection. Previously, they could apply to the EUIPO and obtain UK protection.

3. The covid-19 pandemic has resulted in the creation of new businesses or the diversification of businesses in response.

At its peak in March 2021, the trademark backlog stood at 32,185 trademark applications, with the review process taking 35 days. Now that the backlog of brands has been eliminated Initial Public Offering processes trademark applications within its 10-day period. Initial Public Offering also had a backlog of 9,507 design requests, with 32 days to process a case. This has now also been erased.

Changes to the IPs Register

The huge increase in Initial Public Offeringworkload extended to changes made to the IPs registry, such as changes of address. 2021 saw Initial Public Offering receiving 80,000 more trademark and design requests than it would receive in a typical year. This is a combined increase of 335% more change request forms than an average year, which took 33 days for changes to be processed. This backlog has now been cleared.

Clearing the backlog was a huge team effort for the Initial Public Offering, especially given the considerable challenges faced during Brexit and Covid-19. Their teams made processes more efficient to complete reviews faster. A number of service enhancements have been made to help clear up the patent backlog:

1. Patent reviews have been streamlined to focus on the most important and relevant things first, taking into account legal requirements and client considerations. It saved the Initial Public Offering time, but it’s also better for clients, as they receive clearer and succinct advice on the issues that matter most to them.

2. “Technology clusters” have been created so that work on different topics (eg measuring devices or automobiles) can be shared among a wider group of colleagues. this allows Initial Public Offering to focus our resources on areas where it has the most demand at any given time.

3.
Initial Public Offering improved the way applications were processed so that non-specialist staff could assist examiners in the early work on an application.

For trademarks and designs, given the increase in requests we have seen, Initial Public Offering needed to recruit a number of examiners to cover the continued demand for their services.

But the team also has:

1. Invested in better predictions for trademarks and designs, which enabled Initial Public Offering better plan resources to gain flexibility and meet demand.

2. We reviewed our processes from top to bottom, improving efficiency by managing our workflow differently, adopting new training methods and continuing to make small improvements to Initial Public Offeringsystems.

And after?

Eliminating our backlogs is excellent preparation for Initial Public Offeringnext steps as an organization. The one Initial Public Offering The transformation program is drawing closer, with the new patent service to be launched in just two years. Starting with a clean slate will mean it will be easier to transition people to our new digital services.
